FCC simplifies rules on ex parte presentations.

The FCC has issued a report and order revising its procedures governing ex parte presentations. Its goal is to make it easier for parties to determine when such presentations are allowed and to provide more frequent public reports of ex parte contacts. The order in General Counsel docket 95-21 addresses communications directed to the FCC "on the merits" of a proceeding, but which aren't "served" on parties to the proceeding (in the case of written presentations) or aren't preceded by a public notice (for oral presentations).
The new rules "contain relatively short lists - in comparison with the former rules - of proceedings specified as 'exempt'" or as "permit-but-disclose," the FCC said. All other proceedings will be classified as "restricted." Under the former...
