Punitive tobacco award fought; Cigarette makers hit with Florida ruling, lawsuit by E.U.

MIAMI-Tobacco companies are appealing a Florida circuit court judge's decision to uphold a $145 billion jury award to sick smokers and his refusal to reduce the award and order a new trial. Dade County Circuit Court Judge Robert P. Kaye approved the award Nov. 6. His 68-page order was issued on the same day a federal judge returned the case to Judge Kaye's court.
Meanwhile, a European Commission lawsuit filed in New York last month accuses tobacco companies of smuggling cigarettes into the European Union. And a settlement reportedly is being discussed that would free two cigarette makers from the threat of punitive damages in several other suits pending in New York.
