N.Y. sovereign immunity bars punitive awards A federal court judge in New York set aside a $1 million punitive damages award against New York City in a sexual harassment case, ruling that despite New York City's human rights law, the city still has sovereign immunity from punitive damages.
The decision is the first time a court has ruled on the issue of sovereign immunity with respect to New York law. But the judge did rule against the city on other matters and denied its motion for a new trial in Katt vs. City of New York, a sexual harassment case in which a terminated city employee was awarded $400,000 in compensatory damages and $1 million in punitive damages.
