Wisconsin appeals court overturns pollution rulings MILWAUKEE-The Wisconsin Court of Appeals last Wednesday overturned a $100 million punitive damages award against Wisconsin Electric Power Co. for its role in dumping toxic waste. In addition, the 2-1 ruling overturned a trial court decision that prohibited Wisconsin Electric from pursuing insurance coverage for the punitive damages award.

The suit arose from the discovery of oxide box waste, a byproduct of producing natural gas from coal, on property in West Allis, Wis. The property owners, which included the city, sued Wisconsin Electric to cover cleanup costs.
