ADVOCATES OF CLASS-ACTION litigation reform have good reason to be hopeful that the current Congress will finally get legislation passed. The House of Representatives recently approved H.R. 1115-the Class Action Fairness Act-and now it's up to the Senate to pass its version of the bill with the same name, S.

274. With bipartisan support for class-action reform growing, we think Congress should not squander an opportunity to stop abuses of the current civil justice system. A central provision of both bills would allow plaintiffs and defendants to move large, multistate class actions to federal courts from state courts. This measure would limit forum shopping, an all-too-common practice in which plaintiffs' attorneys file suits in the friendliest courts....
