Cirque du Soleil settles case alleging HIV discrimination.(News)(Equal Employment Opportunity Commission)(Brief Article)

Byline: JUDY GREENWALD LOS ANGELES-The U.S. Equal Employment Opportunity Commission has reached a $600,000 settlement with Cirque du Soleil (U.S.) Inc. over its termination of an HIV-positive performer. Matthew Cusick filed a discrimination case under the Americans with Disabilities Act of 1990 after he was fired as an aerial gymnast by the Montreal-based circus.

According to the EEOC, under terms of the settlement, the circus will pay $300,000 in compensatory damages, the maximum allowed for an individual under the ADA. The settlement includes $200,000 in pay, $60,000 in lost wages and $40,000 in attorneys' fees. EEOC program analyst Santos Albarran said the settlement is one of the largest ever reached by the EEOC.
