After Campbell, drop in punitive damages ratio seen.(Feature)

Byline: Roberto Ceniceros An 18-month-old U.S. Supreme Court decision is helping insurers defend against lawsuits and appears to be contributing to a decline in the size of punitive damage awards. Since the high court's April 2003 decision in State Farm Mutual Automobile Insurance Co. vs.
Campbell, the ratio of punitive damages to compensatory damages has dropped nationwide to 1.6 to 1, said James L. Crandall, an insurance defense attorney at Crandall, Wade & Lowe in Irvine, Calif. In contrast, the ratio in 2002 stood at 4.4 to 1, he said. Other factors also could be at play, though, such as less juror sympathy for plaintiffs with minor complaints at a time when the nation faces difficult challenges such as the war in Iraq, said Mr. Crandall.
