Ruling on Child Porn Law May Free Former Infoseek Executive.(Knight Ridder/Tribune Business News)
Knight Ridder/Tribune Business News, December, 1999 by Marshall, Matt; Quinn, Michelle
Dec. 18--A federal appeals court ruled Friday that the Federal Child Pornography Prevention Act is unconstitutional, saying it outlaws images that are protected by the First Amendment, namely those that merely "appear to be" or "convey the impression" of child pornography.
The ruling is significant because it threatens to shake up pornography law at a time when U.S. legal authorities are struggling to deal with hundreds of criminal cases involving child pornography over the Internet.
For example, it comes a day after a federal jury found former Infoseek executive Patrick Naughton guilty of possessing child pornography in a controversial case that has received nationwide attention. Naughton faces up to 10 years in prison.
