Former Microsoft Temporary Worker Thought She Would Be Hired.(Knight Ridder/Tribune Business News)

Jan. 11--Donna Vizcaino doesn't remember how her name won the top spot in a lawsuit -- against Microsoft -- that is setting the national agenda for how companies treat temporary workers.
But within the temporary employment industry and among the workers who are fighting for better benefits, the name "Vizcaino" (the same as the Spanish explorer who discovered California's Monterey Bay) is becoming a household word.
Vizcaino is the lead plaintiff of a 7-year-old class-action lawsuit that seeks the same benefits for temporary workers that Microsoft gives its permanent employees. The U.S. Supreme Court ruled Monday that it would not hear Microsoft's latest appeal of the case dubbed "Vizcaino v. Microsoft."
