Former Infoseek Executive Wins New Trial.(Knight Ridder/Tribune Business News)

Jan. 22--Former Infoseek executive Patrick Naughton won the latest battle in his Internet sex case Friday when a federal judge tentatively granted a new trial on his one felony conviction.

U.S. District Judge Edward Rafeedie set aside Naughton's child pornography conviction because an appeals court last month ruled parts of the federal child pornography law unconstitutional.

Rafeedie said Friday the conviction would be reinstated if the appeals court ruling is challenged successfully before Naughton's new trial begins in March.

The decision was hardly the end of Naughton's legal troubles. He faces retrial on two felony counts on which the jury had deadlocked in his first trial. Now, all three counts will move ahead together.
