Surfers Lose Ruling on Abercrombie & Fitch's Use of Old Photo in Ad.(Knight Ridder/Tribune Business News)

Mar. 18--A group of legendary surfers has lost a legal challenge against retailer Abercrombie & Fitch, which published a photo of the wave-riders in a risque fashion spread without their permission.
The surfers, who alleged invasion of privacy and defamation among other things, have appealed the ruling. The surfers include Irvine's Paul Strauch and Honolulu-based George Downing, one of the greatest surfers in history.
Downing said Thursday he's confident the case will be won on appeal.
"There's no doubt in my mind," said Downing, 69. "Our lives are private, and I've always been a protector of any abuse I can see against the sport of surfing." In a lawsuit filed in federal court in Santa Ana, the surfers had sought at least $5.5 million...
