Dec. 23--Adding a bit more prestige and clout to Gov. Christie Whitman's new job as administrator of the U.S. Environmental Protection Agency, President-elect George W. Bush said yesterday that he will elevate the position to Cabinet level.

History warns that may be easier said than done.

A Rutgers University environmental law professor said last night that Bush cannot upgrade the EPA administrator post to a Cabinet position without obtaining the approval of Congress.

"He can't unilaterally do it," said Craig Oren, an expert in environmental law and a professor at the Rutgers-Camden School of Law. "He would need Congress' approval."
