Judge Refuses Walt Disney World's Request to Throw Out Suit.

Apr. 18--A federal judge in Orlando has refused Walt Disney World's request to throw out a lawsuit charging that the company stole the idea for its Epcot theme park.

Disney claimed, among other things, that the plaintiffs waited too long after Epcot's 1982 opening to sue.

But U.S. District Judge Patricia Fawsett disagreed, writing that granting a motion for dismissal before trial is "appropriate only in circumstances where the evidence is such that a reasonable jury could not return a verdict" for the opposing side.

Fawsett's April 10 ruling keeps the case on track for its scheduled trial date of October 2004.
