Judge Won't Order Lexington, Ky., Water Company to Keep Documents.

Dec. 17--A judge declined Monday to make Kentucky American Water preserve documents related to the utility's value.

Special Judge Larry Raikes' ruling, however, doesn't give the water company clearance to fire up the shredder, eliminating valuable information the Urban County Government hopes to later use in its condemnation case against the utility.

Although declining to order preservation of the documents, Raikes requested that attorneys for both the city and the utility notify their clients "of the legal duty to preserve all documents and other information and data relating to the value and valuation of KAWC."
