ADA-based suit upheld against First Colony.(Americans with Disabilities Act of 1990, First Colony Life Insurance Co.)

First Colony Life Insurance Co. will have to face a lawsuit alleging that it violated the Americans with Disabilities Act of 1990 (ADA) when it denied a life insurance policy to Itzhak Kotev, who is married to a woman who is HIV-positive. Kotev is suing First Colony on the grounds that he was denied life insurance coverage due to his marriage to a disabled person regardless of his risk of contracting HIV. First Colony had tried to have the lawsuit dismissed, but its motion was denied by the California Central Court.

A California judge has rejected First Colony Life's attempt to dismiss the charges of a man who claims he was denied life insurance coverage in violation of the Americans With Disabilities Act.
