Insurance and employer groups are arguing that a new Department of Labor rule mandating claims and appeals procedures for health insurance plans governed by the Employee Retirement Income Security Act will raise health care costs and lead to an increase in the number of uninsured Americans.

The Clinton administration said the new rule--published in the Federal Register on Nov. 21--is necessary to assure that Americans have fast and fair internal appeals procedures when coverage is denied or delayed.

In a statement, President Clinton said, "Under this new rule, for the first time, health plans would be required to make coverage decisions quickly--within 72 hours for urgent requests and to provide consumers with meaningful information on their rights...
