Carriers Would Not Face Legal Liability If Anti-Terrorism Devices Fail, U.S. Says

WASHINGTON - Carriers that use anti-terrorism technologies approved by the Department of Homeland Security would not face legal liability if those technologies failed to detect or deter such an attack, a government official said.

Under the Support Anti-Terrorism by Fostering Effective Technologies Act, "buyers of such technologies cannot be sued in court," David McWhorter, a researcher with the Institute for Defense Analyses, said here during a recent cargo security forum.

Valerie Smith, a DHS spokeswoman, said the purpose of the act, implemented in late 2004, "is to encourage manufacturers to develop and commercialize technologies that could substantially reduce the risk, or mitigate the effect, of acts of terrorism."
