On 8 November 2006, Sky Capital Holdings, Ltd. ("Sky Holdings") announced that
a search warrant had been executed at its offices.
Sky Holdings' wholly owned US brokerage subsidiary, Sky Capital LLC ("Sky
Capital") believes that evidence obtained by it before and since that search
shows the misuse by the National Association of Securities Dealers, Inc.
("NASD") of its regulatory and examination authority and membership application
process in respect of Sky Capital. Sky Capital further believes that wrongful
conduct by the NASD contributed to the issuance of the search warrant.
