Some ramifications of 2004 workers compensation reforms.(WORKERS' COMP)

A provision in the 2004 reforms is jeopardized by a new lawsuit alleging that it discriminates against women and older workers. At issue is a section making it harder to collect workers' comp funds if the ailment is not entirely work related. According to the suit, a woman aged 76 whose back was broken at work was denied 40% of her claim because her osteoporosis made her vulnerable to on-the-job injuries.
