New York State Supreme Court Justice Herbert A. Posner has ruled that the New York City Council should have been allowed to review and approve a deal that leased Coney Island Hospital to Primary Health Systems-New York (PHS-NY). The ruling is seen as a victory for community activists and the City Council, which had opposed the deal. PHS-NY is a private, for-profit hospital management company.

Vindicated in court, the New York City Council and community activists have delayed, if not derailed, the city's lease of Coney Island Hospital in Brooklyn to a private, for-profit hospital management company.
