FERC imposes first penalties under EPAct of 2005.(Member News)

The Federal Energy Regulatory Commission (FERC) recently imposed its first fines under expanded civil penalty authority provided by the Energy Policy Act of 2005 (EPAct '05), and electric cooperatives should take notice.

Rod Nefsky, National Rural Utilities Cooperative Finance Corporation (CFC) senior consultant in Regulatory Affairs, said that CFC member systems could be affected by FERC rulings, especially in terms of transmission, reciprocity, and reliability issues. While electric distribution cooperatives do not fall under FERC jurisdiction, Nefsky said the FERC emphasized its ability to apply penalties.
