Polluters beware: landmark bill passes Senate. (Legal Ease).

As part of the ongoing legislative trend to penalize polluters, the much-debated yet longshot bill to create a federal law on civil liability for environmental damage passed, with some limitations, the Senate at the end of the spring session. It now returns to the Chamber of Deputies and is expected to be ready for President Fox's signature in the fall.

This bill is remarkable in Mexico for a number of reasons. First, private lawsuits against companies for pollution-related damages are exceedingly scarce due to ceilings on monetary awards and the lack of laws establishing specific causes of action for these suits.
