Ofcom to examine pay TV.

Ofcom, the com-munications regulator, is to investigate the pay TV market following a submission from BT, Setanta, Top Up TV and Virgin Media. One implication of the request is that British Sky Broadcasting (BSkyB) may be acting anti-competitively, and Ofcom will have to decide whether to refer the issue to the Competition Commission.

Of particular concern to those making the submission is the fact that several BSkyB channels are no longer available on Virgin Media's cable network, after the two groups were unable to agree on the price Virgin should pay BSkyB for the channels. Consumer groups including the Ofcom Consumer Panel and the National Consumer Council also expressed concerns about the loss of BSkyB channels on the cable network.
