CEC Wins Appeal of Appliance Ruling.

The California Energy Commission (CEC) announced last week that the Ninth Circuit Court of Appeals has ruled the commission can resume enforcement of a state law requiring appliance manufacturers to disclose energy performance information for their products.

According to CEC, the manufacturers sued the commission in federal district court in November 2002 claiming the disclosure rule violated federal law. CEC noted that while the district court ruled in favor of the manufacturers and placed an injunction on the commission, the appeals court ruling effectively lifts the injunction.
