ROAD TRANSPORT : COMMISSION: HEAVY VEHICLE BAN IN THE TYROL IS DISPROPORTIONATE.

Austria has been asked by the European Commission to drop its prohibition of heavy vehicles in a valley in the Tyrol (the Inn) to fight against air pollution. The European Commission issued a formal opinion on the ban, which relates to a 12 kilometres-long section on the A12 motorway that applies to trucks transporting certain goods (cereals and aggregates) whatever their level of emissions, on July 23. A similar official demand was made in 2003 and had been supported by the EU Court of Justice in a judgement of November 2005 (C-320/03 Business). At the time, the Court had recognised that environmental reasons could justify the banning of the free movement of goods, but that they should be proportionate.
