According to a survey of litigators conducted by Cogent Research (Cambridge, MA) on behalf of LexisNexis (Dayton, OH), more than three-quarters of cases are resolved favorably and litigation expenses are reduced in half in all cases in which early case assessment is performed. Survey results are grouped into three main categories including the impact of early case assessment on litigation, the challenges to performing effective early case assessment and current practice of early case assessment by litigators.
