Time Warner Cable has lost a court challenge that sought to overturn a cap on reach of cable operators and content restrictions imposed by 1992 Cable Television Consumer Protection and Competition Act. Time Warner, second largest cable operator in US, argued that 30 per cent limit on reach violated First Amendment on free speech. Company also challenged limit set on carriage of channels in which the cable company has a financial interest. Under Act, no more than 40 per cent of channels carried can be financially affiliated to the cable system owner. Time Warner argued that Federal Communications Commission had no right to impose such limit, claiming it was akin to limiting print run of a newspaper.
