Judge refuses to dismiss charges against Martha Stewart

NEW YORK (AFP) — A US federal judge rejected moves by US homemaking icon Martha Stewart to have two of the criminal counts against her dismissed, prior to her trial on charges arising from an insider trading scandal.

District Judge Miriam Cedarbaum denied the motion by Stewart's lawyers to dismiss a securities fraud charge as well as a count of obstruction of justice.

Stewart, 62, is also charged with conspiracy, making false statements and lying to the FBI.

Prosecutors charge that Stewart ordered her broker to sell her shares in bio-tech firm ImClone Systems Inc,. after she received an illegal tip that federal regulators would not approve ImClone's anti-cancer drug, "Erbitux."
