FOR TOO LONG, THE PRACTICE OF LAW IN THE UNITED STATES and Britain has been treated with kid gloves, as a learned profession that must be insulated from the more vulgar mores of the marketplace by rules of legal ethics. One manifestation of this attitude is especially visible in England and Wales.

For centuries barristers were the only lawyers allowed to argue before Britain's High Court of Justice. At the same time, however, they could speak to clients only through solicitors, who had a monopoly over negotiating commercial deals and other transactional work.
