Parents of 1 victim in trunk file suits

Two lawsuits contend that the three boys who died in a car trunk last summer in Camden would have lived if police had conducted a proper search and the automaker had advised the owner to retrofit the car with an internal trunk lid release.

David Agosto, who found his son Daniel, 6, and the other boys in the trunk two days after they were reported missing, said yesterday that he had figured police already checked the car.

"That was the last place I expected them to be found," he said. "I thought the police had it under control."

In a lawsuit filed Wednesday in state Superior Court, Agosto is seeking unspecified damages from the City of Camden, its Police Department, and the Toyota Motor Corp. for negligent infliction of emotional distress.
