Hornell Brewing, a "New Age" tea maker, faces class action lawsuits in three different states for claiming that its Arizona line of herbal beverages contains certain herbal ingredients. Rx Memory, for example, allegedly lists herbal extracts that are not contained in the drink.

Hornell recently paid $138,750 to settle similar claims in Los Angeles, California. The company says that the beverage line uses "mere puffery" and makes no fitness assertions about its products.
