Oracle CEO challenges large aircraft curfew at San Jose airport

Larry Ellison, the CEO of Oracle Corp has challenged the legality of a curfew stopping `larger` aircraft weighing over 75,000 pounds from landing at San Jose airport between 11.30pm and 6.30am.

Ellison has been the recipient of one written warning after he has flown his Gulfstream V jet aircraft to the airport during the curfew time and has also been threatened with legal action by the Curfew Monitoring Committee after city officials did not know how to deal with breaches because they have so far never enforced the curfew in the 15-years it has been in place.

However, the Oracle chief says there are two ways in which he is, or at least should be, exempt from the curfew. Ellision maintains that though his aircraft has a maximum capacity of 90,500 pounds he can obtain a certificate attesting that he will not fly at a weight greater than 75,000 pounds. Further, he claims that the city`s curfew is illegal because it is not based on the noise produced by the aircraft, but the weight.

In response, city officials say that if Ellison`s Gulfstream V was exempted the same rule could be applied to certain other aircraft that can fly under 75,000 pounds, but which aren`t small aircraft. They also say that the curfew does follow federal rules that classify noise levels based on weight.

The curfew is currently under review by the Federal Aviation Administration.
