A ruling in a US court that overturned the award by jury of USD565,000 to the family of a victim of an American Airlines crash near Cali, Colombia in 1995 has been upheld by the Supreme Court.

The ruling was overturned in June 1999 when a judge from the 11th US Circuit Court of Appeals in Atlanta stated that the judge in the initial trial should not have decided that the pilot was at fault in the crash, but that this should have been left to the jury to decide.

The case has been sent back to the jury to decide whether or not the American Airline pilots were guilty of `wilful misconduct.`
