Delayed passengers not entitled to compensation from BA under new EU rules - claim

According to a statement from the European Commission on Wednesday (24 August) British Airways will not be liable to pay compensation to passengers affected as result of this month's strike action as European Union compensation rules do not apply.

Around 100,000 passengers travelling with the airline faced long delays earlier this month as a result of the two-day strike action by 1,000 ground crew at London's Heathrow Airport in sympathy for workers dismissed from caterer Gate Gourmet.

The EU introduced new rules in February to compensate passengers ifthey suffer from overbooked flights, cancellations or long delays but according to an EU official these rules "don't apply when there are exceptional circumstances that could not be foreseen by the airline", reported Reuters.

Under the new EU guidelines delayed passengers are entitled to EUR250 for flights less than 1500km, EUR400 for flights between 1500 and 3500km and EUR600 for long-haul flights. A British Airways spokesperson stated that the airline was dealing with claims on a case-by-case basis.
