An AirTran Airways pilot, who was arrested and charged with operating an aircraft whilst under the influence of alcohol, has been dismissed.

While the US federal rules prohibit flying with a blood alcohol level of 0.04 or higher, a breath test allegedly found that the pilot had an alcohol level of 0.09 when he was arrested. The pilot, who was arrested in Nevada, was flown to Atlanta after being released by the police and was dismissed by the airline.

The National Pilots Association, which represents the AirTran pilots, declined to comment on the case, The Associated Press reported. According to AirTran the pilot never took command of the aircraft and the flight was cancelled.

If it is found in a Federal Aviation Administration investigation that the pilot has violated regulations, he could lose his pilot licence.
