ConocoPhillips warns EPA that 'baseline' non-road diesel rule could discourage critical foreign supplies of ULSD

In comments on EPA's proposed non-road diesel rule, ConocoPhillips points out that EPA's "baseline" scheme requiring refiners to predict market demand for various distillates years in advance could lead to "crossover" supply of 500-ppm non-road locomotive & marine (NRLM) fuel to the highway 500-ppm sulfur fuel market during the 2006-2010 ULSD phase-in.

"This open-ended allowance of crossover to the highway market of non-15ppm diesel fuel could discourage investment by refiners, particularly foreign refiners, resulting in less 15-ppm product than anticipated by the Agency in its highway rulemaking," ConocoPhillips warns.
