The Australian Competition and Consumer Commission (ACCC) has received details of advertising and promotional offers from mobile phone operator Hutchison 3G following concern about its AUD99 Talk Cap and Free 10 offers.

A spokesperson for the ACCC said that its concerns about the two offers come from Hutchison 3G's varied fair use policy on the AUD99 Talk Cap offer and the introduction of a fair use policy on the Free 10 deal. In 2003 Hutchison said that its rates would be guaranteed for two years, but the ACCC believes that the fair use policies introduced in 2004 may have contravened consumer protection laws.

Hutchison 3G has now said that it will withdraw the rates guarantee and give specified customers a rate discount on calls that exceed the original AUD99 Talk Cap and Free 10 offers.
