The United States Patent and Trademark Office has issued an Order granting the Public Patent Foundation's Request for Re-examination of Microsoft's patent on the FAT file system.

The Patent Office claimed that the request has raised a substantial new question of patentability regarding every claim of the patent. Microsoft will now make an opening statement to the Patent Office which will be followed by a response from the Public Patent Foundation. The Patent Office will then determine if the patent is valid or not.
