US telecomms group BellSouth Corp (NYSE: BLS) has said that the US Federal Communications Commission (FCC) has granted the company's request on state broadband requirements.

On 9 December 2003 BellSouth asked the FCC to declare that states cannot impose certain requirements on BellSouth's broadband Internet access services.

According to BellSouth, state regulators in Florida, Georgia and Louisiana have rules in place requiring the company to provide either its wholesale broadband transmission or its retail broadband Internet access service over Unbundled Network Element loops leased by competitors.

The FCC action affirms a single national policy and confirms that the FCC, not state regulators, should decide what network elements must be unbundled.
