US District Court affirms Genentech's request for Preliminary Injunction against Novo Nordisk Growth Hormone

Business Wire, June 27, 1996

NEW YORK--(BUSINESS WIRE)--June 27, 1996--Denmark-based pharmaceutical and biotechnology group Novo Nordisk A/S (NYSE:NVO) issued the following statement in response to a US District Court decision in the ongoing patent litigation between Novo Nordisk and Genentech.

"Today, the US District Court, Southern District of New York issued a decision to grant a Preliminary Injunction against Novo Nordisk under a Genentech patent. We are disappointed with the US District Court's decision and will appeal.

"Today's decision by the US District Court is one step in a long and complicated case. It is Novo Nordisk's position that it will be determined at the conclusion of this legal proceeding that the production of Norditropin(R) does not infringe any patents and that the patents asserted against Novo Nordisk by Genentech will be found invalid and unenforceable. Furthermore, we believe that Genentech will be found to have violated US antitrust laws." -0- Novo Nordisk A/S is the world leader in insulin and diabetes care and is the world's largest producer of industrial enzymes. The company manufactures and markets a variety of other pharmaceutical and bioindustrial products. Headquartered in Denmark, Novo Nordisk employs more than 13,300 people in 54 countries and markets its products in 130 countries.
