Supreme Court Denies MSI Challenge to Pall Corporation Patent

EAST HILLS, N.Y.--(BUSINESS WIRE)--March 21, 1997--The United States Supreme Court this week denied Micron Separations Inc.'s (MSI) petition for Certiorari to review the U.S. Court of Appeals decision upholding the 1991 decision of the U.S. District Court for the Eastern District of Massachusetts. This decision confirmed that Pall Corporation's U.S. Patent No. 4,340,479 is valid and was infringed by MSI's nylon membrane.

In a June 1991 decision, Judge William G. Young found that the Pall '479 patent, Pall's basic Nylon membrane patent, was valid; that it was infringed by MSI's sale and manufacture of its Nylon 46 and Nylon 66 membranes; that MSI's sale and manufacture of Nylon 66 and 46 membranes should be enjoined; and that damages should be awarded to Pall, along with certain attorneys' fees. The lower Court has entered judgments against MSI in an amount exceeding $16,000,000.
