Trinity Industries and Johnstown America Settle Lawsuit

DALLAS--(BUSINESS WIRE)--April 3, 1998--Trinity Industries Inc. (NYSE:TRN) today announced that it has settled a 5-year-old patent infringement lawsuit brought against the company by Johnstown America Corp.
Under terms of the settlement, Trinity will pay Johnstown $16.75 million. As a result of amounts previously provided, the settlement will have no effect on Trinity's results of operations for the fourth quarter of fiscal 1998 or any future periods.
The lawsuit involved Trinity's Aluminator II rotary gondola railcar, which was discontinued in 1997. The company has since developed a new rotary gondola. As part of the settlement, Johnstown has agreed not to assert any claim concerning Trinity's new rotary gondola as presently designed.
Trinity President and Chief Operating Officer Timothy R. Wallace said, "Now that these issues are resolved, we can take full advantage of the strengthening coal car market. Our new rotary gondola has been well received by customers and complements our highly successful rapid-discharge coal car. Both are key parts of our coal car business."
