PHOENIX--(BUSINESS WIRE)--April 23, 2001
In a significant victory in favor of consumers' rights to purchase prescriptions over the Internet, RB Products was vindicated in New Jersey Superior Court on Feb. 14, 2001, in connection with a case brought by the New Jersey Attorney General's office and the Bureau of Consumer Affairs.
The court ruled that RB Products was free to continue Internet sales of Viagra to New Jersey residents, it was announced today by Robert Priestley of Mendes & Mount LLP, managing partner of the Newark, N.J., office.
The judge, Honorable R. Benjamin Cohen of the New Jersey Superior Court at the Essex County Courthouse in Newark, ruled in favor of RB Products, thereby rejecting a claim brought by the New Jersey Attorney General, John J. Farmer Jr., and Mark S. Herr, director, New Jersey Division of Consumer affairs, who sought injunctive relief against RB Products.
RB Products Managing Partner Brian Anciaux stated: "RB Products is proud of the fact that we have only the highest standards in our business practices and all the appropriate safeguards in our distribution. We are happy to provide an important medication like Viagra in a way that is secure, confidential and convenient to the people who need it."
Paul Piantino of Mendes & Mount LLP commented: "We are pleased with the judge's decision in RB Products' favor. Given that our client's business practices are well within their rights and the law, we believe Judge Cohen's ruling to be well reasoned and appropriate. An eight month investigation by the Bureau of Consumer Affairs failed to produce the requisite evidence to preclude continued operations of RB Products."
RB Products also operates RBHealth.com. They provide a complete product line of prescription medication, vitamins, herbal supplements, growth hormones and other products. In business since early 1999, RB Products has grown to become one of the most successful health product Web sites in business today.
