MX Logic Sees Unsolicited Commercial Email Senders Making Some Efforts to Comply With CAN-SPAM Act; 12 Percent of Spam Is Partially Compliant

Unsolicited commercial email that is wholly compliant with the law remains at 3 percent, representing no change in month-to-month compliance since the law went into effect on Jan. 1. Seventy-seven percent of all email traffic that passed through the MX Logic Threat Center in April was spam.

"Monitoring by our Threat Center reveals that 12 percent of unsolicited commercial email complies with every facet of the law -- except making the subject line consistent with the body of the email. So, while there is some tip-toeing toward compliance, we continue to see spammers failing to include content consistent with the subject line," said Scott Chasin, chief technology officer, MX Logic.

Chasin noted, however, that recent movement on the enforcement front -- including the six lawsuits filed by ISPs in March and last week's arrest of four inveterate spammers under the CAN-SPAM Act -- will eventually nudge compliance upward.

"As the government continues to flex its full CAN-SPAM Act enforcement muscle, we remain confident that there will be an increase in compliance," he said.

The CAN-SPAM Act requires that unsolicited commercial email senders:

-- Ensure that the "FROM" line clearly reflects the sender's

identity

-- Include subject line text consistent with message content

-- Include the advertiser's valid postal address

-- Contain a working opt-out mechanism as a way for the consumer

to decline to receive further commercial email from the sender
