U.S. District Court Issues Preliminary Ruling in Agilent Technologies' Patent Infringement Lawsuit Against PixArt Imaging

PALO ALTO, Calif. -- Agilent Technologies Inc. (NYSE:A) today announced that the U.S. District Court for the Northern District of California has issued a preliminary ruling in Agilent's patent infringement lawsuit against PixArt Imaging Inc. In the claim construction hearing (also known as a "Markman" hearing), the Honorable Judge James Ware determined the meaning of several disputed terms and phrases in the patent being litigated. Judge Ware's Markman claim construction ruling addresses the interpretation, definition and scope of the claims of U.S. Patent No. 6,433,780.

The Markman process is intended to clarify early how the court will interpret the claims in a patent dispute. Agilent's lawsuit alleges that PixArt infringes U.S. Patents No. 6,433,780, 5,686,720 and 5,786,804, which relate to optical mouse sensor technology. A claim construction hearing for U.S. Patent Nos. 5,686,720 and 5,786,804 is scheduled for November 2005.
"Judge Ware's ruling following claims construction for U.S. Patent No. 6,433,780 is a significant milestone in the lawsuit," said Ngoh Kee Hane, vice president and general manager of the Navigation Products Division in Agilent's Semiconductor Products Group.
Agilent is seeking to stop PixArt from selling optical mouse sensors that infringe Agilent patents to companies manufacturing optical mice that are imported, distributed or sold in the United States. Agilent also is seeking damages from PixArt for its unauthorized use of Agilent's patented optical mouse sensor technology, and for PixArt's infringement of Agilent's patents.
