Business Wire, April 4, 2006

TEXARKANA, Texas -- IBM and Boston-based Sky Technologies, LLC, announced today that they have settled a lawsuit brought by Sky Technologies in the U.S. District Court for the Eastern District of Texas alleging patent infringement, breach of contract and misappropriation of trade secrets. Under the terms of the settlement, IBM has agreed to license Sky's patents and technology for conducting online negotiation.

The case was before U.S. District Judge David Folsom. Financial terms of the agreement have not been disclosed. Sky settled a similar lawsuit last year with i2 Technologies, Inc., of Dallas. Under the terms of that settlement, i2 also agreed to license Sky's patents and technology. In both cases, Sky was represented by Steve Susman and Max Tribble of the law firm of Susman Godfrey in Houston, and George Schwab from Townsend and Townsend and Crew in San Francisco.
