Business Wire, June 23, 2006

SAN JOSE, Calif. -- Following an indictment obtained today from the Santa Clara County District Attorney's Office, in which Norcal Waste Systems was named along with Mayor Ron Gonzales, the company said it would vigorously fight the charges.

The company issued the following statement:

"Norcal Waste Systems denies any wrongdoing in connection with its bid for a garbage and recycling contract with the City of San Jose. Norcal committed no crime, either in the bidding process or in performance of the contract.

"Norcal will contest these charges vigorously and the company expects to be vindicated in court.

"Norcal complied with the procedures established by the City of San Jose, and acted appropriately in connection with the bid and the contract.

"Norcal, which is a 100 percent employee-owned company, takes considerable pride in the services it provides to the City of San Jose.

"Ultimately, the company is confident a jury will find Norcal innocent of the charges in the District Attorney's indictment."
