U.S. District Court Denies Elan Microelectronics' Motion to Dismiss in Avago Technologies' Lawsuit

SAN JOSE, Calif. -- Avago Technologies today announced that the Honorable Judge James Ware of the U.S. District Court for the Northern District of California has denied without prejudice Elan Microelectronics Corp.'s motion to dismiss for non-infringement of Avago's U.S. patents 6,433,780 and 5,786,804 in the patent infringement lawsuit Avago filed against Elan on Dec. 20, 2004. In the motion, Elan had argued on technical terms that it did not infringe those two Avago patents. With the court's decision, Avago's lawsuit will proceed against Elan.

Avago's lawsuit alleges that Elan and its U.S. subsidiary, Elan Information Technology Group, infringe Avago's U.S. Patent Nos. 6,433,780 and 5,786,804, which relate to optical mouse sensor technology. In this U.S. lawsuit, Avago is seeking to stop Elan from selling infringing optical mouse sensors. Avago is also seeking damages from Elan and its U.S. subsidiary for their unauthorized use of Avago's patented optical mouse sensor technology.
