iMDsoft Announces that United States Patent Office Orders Second Re-Examination of Visicu Patent

BOSTON -- In response to a formal request filed by iMDsoft, the United States Patent and Trademark Office (USPTO) ordered re-examination of a health care services patent owned by Visicu, Inc. The USPTO found that prior art provided in iMDsoft's request raises "a substantial new question of patentability" regarding all twenty-six claims of Visicu's patent. This prior art includes iMDsoft's own patent disclosure, which pre-dates Visicu's patent. All of the claims in Visicu's patent are affected.
This is the second time the USPTO has decided to re-examine Visicu's patent, U.S. Patent No. 6,804,656, entitled "System and Method for Providing Continuous, Expert Network Critical Care Services from a Remote Location(s)." On April 7, 2005 a first re-examination of Visicu's patent was order by the USPTO in response to a request filed by iMDsoft. The first re-examination ended with Visicu being forced to change its claims to have a narrower scope. According to recently compiled statistics by the USPTO, over 70% of re-examinations are successful in having a patent narrowed or completely revoked.
