Codon Devices Files Complaint against Febit Seeking Declaratory Judgment

CAMBRIDGE, Mass. -- Codon Devices, Inc., the Constructive Biology Company[TM], announced today that on June 29, 2007 it filed a complaint for a declaratory judgment against Febit Biotech GmbH, Febit Ferrarius Biotechology GmbH, and Febit, GmbH (collectively, "Febit") in the U.S. District Court for the District of Columbia.
In its complaint, Codon Devices seeks a judgment declaring that Codon Devices is not infringing U.S. Patent No. 6,586,211 (the "'211 patent"), which is purportedly owned by one of the Febit defendants, and that the '211 patent is invalid and unenforceable. In addition, Codon Devices requests an order from the Court restraining Febit from asserting the '211 patent against Codon Devices and from making representations that Codon Devices' products and services infringe the '211 patent. Further, Codon Devices seeks reimbursement for expenses in an unspecified amount.
Codon Devices also announced today that on July 9, 2007 Febit Biotech served Codon Devices with a complaint filed in the U.S. District Court for the District of Delaware alleging that Codon Devices infringes the '211 patent. Codon Devices believes the allegations are meritless.
